American Vision Partners, an eye care company operating in Arizona, Nevada, and New Mexico, agreed to settle claims stemming from a data breach that occurred in November 2023. During this incident, an unauthorized third party gained access to the company’s computer network, compromising sensitive patient information belonging to 1.6 million individuals.

The class action lawsuit alleged that the company failed to implement reasonable cybersecurity measures, which plaintiffs claimed could have prevented the data breach. The specific claims centered on the company's alleged failure to maintain adequate security protocols, though American Vision Partners has not admitted any wrongdoing regarding these allegations.

Under the settlement terms, class members are eligible for either a pro rata cash payment or reimbursement for documented out-of-pocket expenses, with potential recovery up to $3,000 for losses like identity theft or professional fees. To receive benefits, class members must submit a valid claim form by November 12, 2026, as the deadline for exclusion and objection is October 13, 2026.
